{"id":736,"date":"2021-04-24T13:55:16","date_gmt":"2021-04-24T13:55:16","guid":{"rendered":"https:\/\/conservativenewsfrommontana.news\/?p=736"},"modified":"2021-04-24T13:55:17","modified_gmt":"2021-04-24T13:55:17","slug":"montana-continues-to-call-for-judicial-accountability","status":"publish","type":"post","link":"https:\/\/conservativenewsfrommontana.news\/index.php\/2021\/04\/24\/montana-continues-to-call-for-judicial-accountability\/","title":{"rendered":"Montana Continues To Call For Judicial Accountability"},"content":{"rendered":"\n<p>By Tim Ravndal<\/p>\n\n\n\n<p>The Montana State Council On Judicial Accountability (<a href=\"https:\/\/mtscoja.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">MtSCOJA<\/a>) is seeking reconsideration of&nbsp;<a href=\"https:\/\/leg.mt.gov\/bills\/2021\/billhtml\/HB0685.htm\" target=\"_blank\" rel=\"noreferrer noopener\">HB685<\/a>&nbsp;that would entrust state judicial oversight outside of the judicial system for the people.<\/p>\n\n\n\n<p><em><strong>\u201cThe goal with the legislation is effective judicial oversight, not a power struggle, supposedly over separation of government powers\u201d&nbsp;<\/strong><\/em>says Bart Crabtree, president of the Montana State Council On Judicial Accountability (MtSCOJA).<\/p>\n\n\n\n<p>The non-government, nonprofit organization (NGO) inspired&nbsp;<a href=\"https:\/\/leg.mt.gov\/bills\/2021\/billhtml\/HB0685.htm\" target=\"_blank\" rel=\"noreferrer noopener\">HB685<\/a>&nbsp;which failed by House vote after being passed by the House Judiciary Committee. That defeated legislation would have made way for an amendment of the Montana Constitution to rename and restructure the state\u2019s&nbsp;<strong><em><a href=\"https:\/\/courts.mt.gov\/courts\/supreme\/boards\/jsc\" target=\"_blank\" rel=\"noreferrer noopener\">Judicial Standards Commission<\/a><\/em><\/strong>&nbsp;to the&nbsp;<em><strong>Judicial Inquiry Commission<\/strong><\/em>&nbsp;comprised of one retired district judge, one attorney, and seven citizens who are<br>neither judges nor attorneys.<\/p>\n\n\n\n<p>The bill was sponsored by Representative&nbsp;<a href=\"https:\/\/leg.mt.gov\/legislator-information\/roster\/individual\/20211\/16525\" target=\"_blank\" rel=\"noreferrer noopener\">Brad Tschida<\/a>&nbsp;(R-HD97) and may have been a casualty of the recent turf war between Montana\u2019s Republican-led<br>legislature and heavily Democrat-influenced judiciary.<\/p>\n\n\n\n<p><a href=\"https:\/\/leg.mt.gov\/bills\/2021\/billhtml\/SB0140.htm\" target=\"_blank\" rel=\"noreferrer noopener\">SB140<\/a>&nbsp;was passed and signed by the Governor of Montana. That legislation launched a court battle over certain coveted power to control the fate of some Montana state judges and justices.&nbsp;<strong><em>SB140<\/em><\/strong>&nbsp;bill became law and accordingly eliminated Montana\u2019s Judicial Nomination Commission, giving Governor Greg Gianforte unfettered power to fill state judicial vacancies.<\/p>\n\n\n\n<p>Having to defend against a lawsuit challenging the constitutionality of that arrangement prompted state Attorney General Austin Knudsen to subpoena results of a poll suggesting the Montana Supreme Court justices presiding over the case were biased against the legislation at issue.<\/p>\n\n\n\n<p>Apparently before its enactment, all the justices were asked their views on&nbsp;<strong><em>SB140<\/em><\/strong>&nbsp;which they shared via emails that the Court\u2019s<br>administrator, Beth McLaughlin, reportedly deleted after receiving Knudsen\u2019s referenced subpoena. McLaughlin\u2019s arguable obstruction of justice is proving no more scandalous than related emails retrieved.<\/p>\n\n\n\n<p>It is claimed that the emails allegedly including some of&nbsp;<a href=\"https:\/\/courts.mt.gov\/courts\/supreme\/bios\/mcgrath\" target=\"_blank\" rel=\"noreferrer noopener\">Montana\u2019s Chief Justice Mike McGrath<\/a>&nbsp;that proposed lobbying against&nbsp;<strong><em>HB685<\/em><\/strong>, stating \u201c. . . t<em><strong>he problem here is it allows a citizen\u2019s commission to discipline or remove judges\u201d and describing the bill\u2019s proposed Judicial Inquiry Commission as \u2018Where Democracies Go To Die\u2019.<\/strong><\/em><\/p>\n\n\n\n<p><strong>While Republican and Democrat state legislators chide each other\u2019s response to Montana\u2019s SB140 Scandal, MtSCOJA endeavors to rise above the fray.<\/strong><\/p>\n\n\n\n<p><strong>According to Tracy Parrish, the NGO\u2019s Public Relations Director<em>~<\/em><\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><strong><em>\u201cWe take basic cues from the National Forum On Judicial Accountability (NFOJA), a legislative initiative to maximize constitutionally sound, direct citizen judicial oversight, primarily by eliminating state judicial self-policing\u201d, Parrish explained. The \u201cAbout\u201d page of NFOJA\u2019s online social network claims, \u201can imbalance of power results between judges and other Americans when judges directly or substantially control all the government processes for challenging their official conduct\u201d and distinguishes \u201cthat imbalance of power from considerations of judicial corruption and related abuses of power.\u201d<\/em><\/strong><\/p><\/blockquote>\n\n\n\n<p>MtSCOJA\u2019s website shares similar sentiments. President Bart Crabtree emphasized;&nbsp;<em>\u201cThere are given indications that Montana Supreme Court justices consider lay citizens incapable of competently resolving judicial misconduct disputes.<\/em>\u201d<\/p>\n\n\n\n<p>Mr. Crabtree goes on to state:&nbsp;<em>\u201cState court judges are known to contend that only they are qualified to regulate and discipline themselves. Citizens of Montana who are not nor ever have been lawyers already resolve legal issues often much more complicated than whether a judge has been ethical through our service as jurors and grand jurors.\u201d<\/em><\/p>\n\n\n\n<p>Looking back to the&nbsp;<strong><em>SB140<\/em><\/strong>&nbsp;Scandal and the arguable lobbying against&nbsp;<strong><em>HB685<\/em><\/strong>&nbsp;it shows and may even further reveal the need for action including plans to seek reconsideration of&nbsp;<strong><em>HB685<\/em><\/strong>&nbsp;by the House.&nbsp;<em><strong>\u201cThis bill is a good first step towards a fair and impartial administration of justice in the State of Montana<\/strong><\/em>\u201c. Mr. Crabtree added that;&nbsp;<em><strong>\u201cIf we have to wait until 2023 to make a first step, it should be bigger \u2013 closer to the strategy for random selection of only lay citizens as NFOJA proposes.
